These Terms of Service (“Terms”) govern your access to and use of Pollbun (“the Service”) operated by Pollbun at pollbun.com. By accessing or using the Service, you confirm that you are at least 18 years old and agree to these Terms.
2. Description of Service
Pollbun is a software-as-a-service (SaaS) platform that allows users to create, distribute, and analyze polls and surveys. We offer multiple subscription tiers billed annually, starting at €100/year.
3. Account Registration
To use Pollbun, you must create an account with a valid email address and password. You are responsible for:
- Maintaining the confidentiality of your login credentials.
- All activity that occurs under your account.
- Notifying us immediately of any unauthorized use at support@pollbun.com.
4. Subscriptions and Billing
All Pollbun plans are billed annually. By subscribing, you authorize us to charge your payment method through Lemon Squeezy, our payment processor.
- Subscriptions automatically renew unless cancelled before the renewal date.
- You may cancel your subscription at any time from your account settings.
- Upon cancellation, you retain access until the end of your billing period.
- All prices are in Euros (€) and include applicable taxes.
- We reserve the right to change pricing with 30 days’ advance notice.
5. Refund Policy
We offer a 30-day money-back guarantee on all paid plans. See our full Refund Policy for details. Refunds are processed through Lemon Squeezy back to your original payment method.
6. Acceptable Use
You agree not to use Pollbun to:
- Violate any applicable laws or regulations.
- Create polls that are deceptive, fraudulent, or misleading.
- Collect sensitive personal data through polls without proper consent.
- Spam or send unsolicited communications to poll respondents.
- Interfere with or disrupt the integrity of the platform.
- Attempt to gain unauthorized access to any part of the service.
- Resell or sublicense access to Pollbun without written permission.
7. Intellectual Property
Pollbun and all associated content, trademarks, and software are owned by us. You retain ownership of poll content you create. By using Pollbun, you grant us a limited license to store, display, and process your content solely to operate the service.
8. Limitation of Liability
To the maximum extent permitted by law, Pollbun shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability shall not exceed the amount paid by you in the 12 months prior to the claim.
9. Disclaimer of Warranties
The service is provided “as is” and “as available” without warranty of any kind. We do not guarantee the service will be uninterrupted or error-free.
10. Termination
Either party may terminate this agreement at any time. We may suspend or terminate your account immediately if you breach these Terms. Upon termination, your data will be deleted after a 90-day grace period.
11. Governing Law
These Terms are governed by applicable law. Disputes shall be resolved through good-faith negotiation first, then binding arbitration if needed.
12. Changes to Terms
We may update these Terms from time to time. We will notify you by email or by posting a notice on the website at least 14 days before changes take effect.
